General Civil Matters
Representative matters includes:
• In a recent civil litigation matter for
one of our larger clients, we achieved a settlement for the client on
a defaulted contract. Under the settlement, the client will receive
a significant payment which equates to approximately 80 percent of an amount
owed from a national restaurant chain.
• Represented a creditor and successfully
recovered over $100,000 out of an individual's bankruptcy for a retiree
who had been induced to invest savings in a fraudulent investment plan.
• Performed pro bono legal services over several
years in federal and state courts for an individual whose ex-husband
filed successive Chapter 7 proceedings to avoid spousal debts.
• Represented Cook Children's Medical Center,
assisting the hospital Chaplain obtain a license to allow her to publish
and distribute a book she wrote entitled The Legend of Prayer Bear
to patients and their families. Our attorneys negotiated and drafted
the non-exclusive license agreement by which the hospital could use
the previously trademarked name.
• Defended a computer chip manufacturer in
a state court collection suit where the plaintiff was seeking to recover
charges under a maintenance agreement. Achieved a 75 percent reduction
in our client's repayment amount by vigorously pursuing all defenses
available to client.
• Pro bono representation of an individual
to collect damages to her vehicle caused by a crane on an adjacent construction
site. Recovered 100 percent of her claim.
• Represented an individual plaintiff in a
medical malpractice suit which involved significant injury due to botched
gall bladder surgery. The firm did significant pre-trial work and prepared
a complete settlement package for the defendant's use in determining
their liability. We successfully resolved the case without filing suit
after mediation.
• Pro bono representation of an individual
film producer in negotiating various royalty/usage agreements relating
to national distribution rights of documentary films.
• Defended a corporate client in a Federal
district court suit to recover damages for alleged misrepresentation,
usury, and violating the Texas DTPA.
